Scope of This Privacy Policy
InterActual® Technologies, Inc. ("InterActual") is committed to protecting your
personal information and respecting your privacy, while offering you a fun,
personalized entertainment experience. This document describes the privacy policy
for the InterActual Player software only – it does not apply to other online or
offline InterActual sites, products or services. Privacy policies for information
collected in other InterActual sites, products or services may be contained from time
to time in the applicable sites, products or services.
What Personally Identifiable Information Does InterActual Player Gather?
InterActual Player collects no personally identifiable information (name, address,
telephone, email) from you. InterActual Player does not require nor accept any personally
identifiable information when using one of its many features.
What Information Does InterActual Player Automatically Send Across the Internet?
InterActual Player sends anonymous information over the Internet to deliver a fun,
personalized entertainment experience and to better understand how our products and
services are used so we can continually improve them. To provide you with all of the
services of InterActual Player, InterActual has tightly integrated Internet
capabilities. The following sections describe the information that is automatically
transmitted to InterActual servers and how it is used.

Demographic information,
which consists of zip code, age and gender information. This information may be
entered by you when you install InterActual Player, or modified at any time by using
the Configuration Dialog. The demographic information is gathered only through the use
of InterActual Player and can only be read by InterActual servers. You can modify the
demographic information passed to InterActual web sites by editing the zip code, age and
gender information entered in the InterActual Player Configuration Dialog. |

System configuration
information, which tells us the configuration of your system on which InterActual Player
resides. System configuration information includes information such as your
DVD navigator, DVD decoder, graphics drivers, display resolution, and audio drivers.
The system configuration information is gathered only through the use of InterActual
Player and is stored locally on your hard drive. The information is transferred from
your hard drive to InterActual’s servers on an anonymous basis once an online
connection is detected by InterActual Player. The information does not contain any
personally identifying information, only anonymous information relating to your system.
You can turn off the passing of system configuration information to InterActual servers
at any time by using the InterActual Player Configuration Dialog. |

Product usage information,
which gives us information about the discs played on your system on which InterActual
Player resides. The product usage information is gathered only through the use
of InterActual Player and is stored locally on your hard drive. The information is
transferred from your hard drive to InterActual’s servers on an anonymous basis once
an online connection is detected. The information does not contain any personally
identifying information, only anonymous information relating to product usage behavior.
You can turn off the passing of product usage information to InterActual servers at any
time by using the InterActual Player Configuration Dialog. |

Software and disc upgrade
information, which gives us information about the versions of software and discs
played on the system on which InterActual Player resides. This allows InterActual and
the disc publisher to offer you updates based on the specific version of the software
you are running, and based on the specific disc(s) you are playing. The software and
disc information are gathered only through the use of InterActual Player and are
automatically passed online to InterActual’s servers on an anonymous basis once an
online connection is detected. The information does not contain any personally
identifying information, only anonymous information relating to your software and the
disc currently in the drive. It is used to notify you of updates available to you
based on the version of software you are currently running and the disc you are
currently playing. It is not possible to turn off the passing of software and title
upgrade information to InterActual’s servers as this information is required for
performing version control and required content updates. |
The system configuration information will be used by InterActual (its employees and
contractors, if any) only for technical support purposes and will not be provided to
unrelated third parties. The anonymous demographic information, product usage
information, and software and title upgrade information will be used primarily for
marketing and commercial purposes, including market and product research and analysis,
by InterActual and third parties. InterActual may make this anonymous information
available to third parties including unrelated third parties for commercial exploitation,
and may itself commercially exploit such information. For instance, InterActual will
use this information to better understand the quality and use of its products and
services and to provide you with more information and services based on your
preferences.
What Other Information is Collected When I Go Online with InterActual Player?
InterActual uses the following methods to collect and transmit certain other
kinds of information when you connect online, including:

Cookies, which allows
InterActual servers to anonymously and uniquely identify each individual system,
collect Internet connection information (such as which browser is used) from your
system, collect the demographic data (if you have provided this information), and
to collect disc identifying information (which disc is currently in the drive).
Many websites use “cookies”, a small piece of information stored on your local
computer, to track users and usage information and to tailor websites and feedback
to the needs and preferences of the user.
Cookies are collected and transferred to InterActual servers automatically when you
go online, separately from how system configuration information, product usage
information, and software and title upgrade information may be collected locally and
transferred to InterActual as described above. Cookies are used to enhance your
experience with our products and services. Our cookies do NOT gather personally
identifying information.
InterActual may place the following anonymous information in one or more cookies:
- Cookie versioning information
- User ID (your numeric representation in the InterActual database)
- InterActual Player-specific information, such as language, versions,
DVD navigator information, current skin and other information pertaining
to configuration settings of InterActual Player
- Disc-specific information, such as the disc currently in the drive
- Demographic data (age, gender, zip code) entered by you in the Configuration Dialog
Like many web and e-commerce sites, InterActual uses cookies to “recognize”
your Internet browsing and InterActual Player software in order to display
information that is relevant to you and to cache some elements of InterActual
web sites and services to improve their performance. When you visit InterActual
web sites and use our products and services, InterActual cookies are sent to
InterActual servers.
Primarily, InterActual uses cookies to better customize the specific pages,
content, banners, and promotions that you will see when you visit InterActual
web sites and use InterActual products and services. For example, we are able
to deliver premium or trial content, programming, services or software
features based on the disc you are currently playing.
InterActual also uses cookies to understand traffic patterns on InterActual
web sites so that we can enhance your experience and provide you with more
relevant information about InterActual products and the content available on
our web sites.
To prevent cookies from being stored on your computer:
a. In Internet Explorer, on the Tools menu, click Internet
Options, and then click the Security tab.
b. Move the security level zone slider up to High. On this setting,
Web sites will not be able to store cookies on your computer.
Note: Changing the security level may affect the speed at which your
computer interacts with Web sites that expect to put cookies on your
computer.

IP Address, which is a number that is used by computers on the
network to identify your computer so that data (such as the web pages you request)
can be sent to you. Your computer uses IP addresses every time you are connected to
the Internet. InterActual servers automatically collect IP addresses. From time to
time, InterActual may use information derived from your IP address to deliver to
you appropriate products, services and software and to prevent fraud. For example,
InterActual may block the ability to purchase specific InterActual services if we
detect an international IP address and we are prohibited from selling that specific
service outside of the United States. |

User ID, which is an alphanumeric identifier used to indicate a unique
installation of InterActual Player. InterActual and third party content providers
may use the User ID for aggregate statistical analysis, to measure product
performance, to authenticate premium content and to personalize products and
services. InterActual does not relate User ID to other personal information supplied
by users, unless you provide advance consent to do so. |
Can I Access and Review the Personal Information Being Gathered from My System?
Since no personally identifying information is being gathered from you, it is not
possible for InterActual to give access to you to the information being gathered from
your system, since the two cannot be matched.
Even though InterActual website(s) may collect personally identifying information
if separately provided by you in such website, such information is not matched by
InterActual with information collected by InterActual Player. Such personally
identifying information is not covered by this privacy policy and is subject to the
privacy policy, if any, provided for such information in the applicable website.
How Does InterActual Player Detect an Internet Connection?
InterActual Player automatically attempts to detect Internet connectivity by
“pinging” one or more IP addresses. If the ping returns successfully, then an
Internet connection is assumed to exist. If the ping does not return successfully,
InterActual Player will periodically attempt to ping predefined IP address(es) to
check for Internet connectivity.
Revision of this Privacy Policy
This Privacy Policy is dated April 1, 2002, and is subject to change by
InterActual from time to time. For purposes of this privacy policy, “InterActual”
also includes its successors and assigns, as applicable.
